California employers should be aware of a new notice obligation under the Workplace Know Your Rights Act (the “Act”), which became effective January 1, 2026. The California Labor Commissioner has now released an official model notice, and employers must begin providing it to employees by February 1, 2026.
Overview of the New Requirement
The Act requires employers to furnish employees with a new written notice explaining certain workplace rights and legal protections. The notice serves as a reminder to all employees regarding their rights in the workplace, particularly related to immigration. It does not create new rights or obligations for employees or employers.
The Labor Commissioner has published a standardized notice that may be used to satisfy the law’s requirements. At present, the notice is available in English and Spanish, with additional translations expected. Employers can find the notices below:
Language and Delivery
Employers must provide the notice in the language they customarily use for employment communications and that the employee understands. If no official translation exists in that language, the notice may be provided in English.
The notice must be distributed to current employees by February 1, 2026, provided annually thereafter, and given to new hires at the start of employment.
Delivery may be electronic—such as by email or text message—so long as it is reasonable to expect receipt within one business day. Employers should assess whether electronic delivery is appropriate for their particular workforce.
Record Retention
Employers are required to maintain records documenting compliance for three years, including the dates on which notices were issued or transmitted to employees.
