Description: California law requires all employers with five or more employees to provide Sexual Harassment Prevention Training to their employees every two years. Supervisors and managers are required to participate in two hours of training, while employees are required to participate in one hour of training.

PAGA and Dynamex Recent Developments

Description: The Labor Code Private Attorneys General Act of 2004 (“PAGA”) authorizes aggrieved employees to file lawsuits to recover civil penalties on behalf of themselves, other employees, and the State of California for Labor Code violations. As the name suggests, this is not a new statutory scheme; however, it has gained significant traction in the past few years to the detriment of California’s business owners. We will discuss what PAGA is, why it has gained so much traction, and how to protect your business from these types of claims.

The holding in Dynamex Operations West, Inc. v. Superior Court, 4 Cal.5th 903 (2018), continues to have a significant impact on the classification of independent contractors. We will discuss recent developments in the implementation of this ruling, and what steps are being taken to limit the Court’s holding.
